2. Products & Product Information
We take reasonable care to ensure that product descriptions, specifications, photographs, dimensions, weights, colours, compatibility information and prices displayed on our website are accurate.
Much of this information is provided by manufacturers and suppliers and may occasionally be changed or updated without notice.
Product images are intended to provide an accurate representation of the product; however, colours may vary slightly depending on photography, lighting, screen settings and manufacturing variations.
Dimensions, weights, volumes and other measurements are approximate unless specifically stated otherwise.
Minor differences between published and actual measurements which do not materially affect the use of the product will not normally mean that the product is faulty or misdescribed.
Nothing in these Terms & Conditions affects your statutory rights where goods are faulty, not as described or otherwise do not conform to the contract.
3. Product Availability
All products are subject to availability.
We use stock information from our own warehouses, fulfilment locations, suppliers and retail partners. Although we make reasonable efforts to keep stock information accurate, there may occasionally be circumstances where an item shown as available has already sold or is otherwise unavailable.
Some products, particularly larger items such as nursery furniture, may be dispatched directly from a manufacturer, supplier or fulfilment partner.
Where an item has an estimated lead time, this is an estimate rather than a guaranteed delivery date unless expressly stated otherwise.
If we are unable to supply an item you have ordered, we will contact you and may offer an alternative, revised delivery estimate or refund as appropriate.
4. Prices, VAT & Payment
Prices displayed on our website are shown in Pounds Sterling (GBP) or Euros (EUR), depending on the relevant market, customer location and payment method.
Where applicable, prices include VAT at the appropriate rate unless otherwise stated.
The final price payable, including applicable taxes and delivery charges, will be displayed during checkout before you place your order.
Where a bank, card issuer or payment provider performs a currency conversion, its own exchange rate and/or charges may apply. We have no control over exchange rates or charges applied by a customer's bank, card issuer or other payment provider.
We accept the payment methods displayed at checkout.
Payment must be authorised before an order can be processed.
If we discover an obvious pricing or promotional error, we reserve the right not to accept the affected order. If payment has already been taken, we will contact you and arrange an appropriate refund if the order cannot be fulfilled at the displayed price.
5. Placing an Order & Formation of Contract
When you place an order, you are making an offer to purchase the products in your basket.
An automated order confirmation confirms that we have received your order. It does not mean that we have accepted your order.
A contract for the sale of goods is formed when we accept your order by dispatching the goods or otherwise expressly confirming acceptance.
Where an order is fulfilled in separate shipments, acceptance may occur separately in respect of each shipment.
We reserve the right to decline or cancel an order before acceptance where, for example:
- payment cannot be authorised;
- the product is unavailable;
- there is an obvious pricing, description or promotional error;
- an offer or discount has been used contrary to its terms;
- we reasonably suspect fraudulent or unauthorised activity;
- we are unable to deliver to the address provided; or
- we are otherwise unable lawfully to fulfil the order.
If we cancel an order after payment has been taken but before goods have been supplied, the relevant amount will be refunded.
6. Order Fulfilment
Samuel Johnston operates a multi-location fulfilment network.
Orders may be dispatched from different warehouses, suppliers or fulfilment partners depending upon product availability, the products ordered and the customer's delivery address.
We operate fulfilment facilities in Belfast (UK) and Dublin (Ireland) and will, where practicable, fulfil orders from the location most appropriate to the delivery destination.
An order containing multiple products may be split into separate shipments, and those shipments may arrive at different times.
This does not affect the total amount you have agreed to pay unless we contact you and you expressly agree otherwise.
7. Delivery
Available delivery methods, estimated delivery times and applicable charges are displayed on our website and/or at checkout.
We make reasonable efforts to dispatch in-stock orders promptly. Delivery estimates are estimates unless expressly stated to be guaranteed.
Deliveries will normally be made to the delivery address supplied when the order is placed.
Please ensure that the delivery address and contact details supplied are complete and accurate. We cannot accept responsibility for delays or additional costs caused by incorrect or incomplete information supplied by the customer.
You will normally receive confirmation when your order has been dispatched. Where tracking is available, tracking information will also be provided.
We may use different delivery providers depending on the destination, size, weight, value and nature of the consignment.
We reserve the right to upgrade or change a delivery service where an alternative service is more appropriate for the consignment, provided this does not materially disadvantage you.
8. Failed, Refused & Unsuccessful Deliveries
Customers are responsible for providing an accurate delivery address and, where required, making reasonable arrangements to receive their delivery.
If delivery cannot be completed because of circumstances for which the customer is responsible — for example, an incorrect address, refusal of delivery or repeated unsuccessful delivery attempts — the goods may be returned to us.
Where this happens, we may deduct from any refund reasonable direct costs actually incurred as a result, where permitted by law. These may include:
- outbound delivery costs;
- return carriage;
- courier handling charges;
- storage charges; and
- specialist pallet or bulky-item transport costs.
For large, heavy or palletised goods, return transportation costs can be significant.
Where redelivery is requested, we may require payment of reasonable additional delivery costs before arranging redelivery.
Nothing in this section affects your statutory rights where delivery has failed because of something we or our delivery provider are responsible for.
9. Receiving & Checking Your Order
Please inspect your order as soon as reasonably possible after delivery.
We ask that any visible damage, shortages, incorrect products, colours or quantities are reported to us within 3 working days of delivery wherever possible.
Reporting these issues promptly enables us to investigate with our warehouse, supplier or delivery provider and resolve the matter as quickly as possible.
When contacting us, please provide your order number together with photographs of the product, packaging, shipping carton and delivery label where relevant.
Failure to report an issue within 3 working days does not remove any statutory rights you may have in relation to faulty, damaged, incorrect or misdescribed goods.
10. Cancelling an Order Before Dispatch
If you wish to cancel an order, please contact us as soon as possible.
Because orders may be processed and dispatched quickly, we cannot guarantee that a cancellation request will reach the warehouse before dispatch.
If we successfully cancel the order before dispatch, any payment taken for the cancelled goods will be refunded.
11. Cancellation After Dispatch & Returns
Once an order has been dispatched, it may no longer be possible to stop the delivery.
If you change your mind after dispatch, you may exercise any applicable cancellation and return rights in accordance with our Returns Policy and applicable consumer law.
Where the return results purely from a change of mind, the customer may be responsible for the cost of returning the goods where permitted by law and as explained in our Returns Policy.
Where a delivery is refused rather than accepted and returned in accordance with our returns procedure, reasonable costs incurred in recovering the goods may be deducted from any refund where legally permitted.
Our full Returns Policy is available separately on our website and forms part of these Terms & Conditions.
12. Condition of Returned Goods
Where a consumer exercises a right to inspect goods and subsequently return them, the goods should not be handled beyond what is reasonably necessary to establish their nature, characteristics and functioning.
Where permitted by law, we may make an appropriate deduction from a refund to reflect any reduction in value resulting from unnecessary handling.
This may include circumstances where:
- an item has been used beyond what is reasonably necessary to inspect it;
- components or accessories are missing;
- the product or packaging has been damaged through unreasonable handling; or
- the condition of the returned product has materially reduced its value.
This does not affect your rights where goods are faulty, damaged, incorrect or not as described.
13. Faulty, Damaged or Incorrect Goods
If goods are faulty, damaged, incorrect or not as described, please contact us as soon as reasonably possible.
We may ask you to provide photographs, video or other information reasonably necessary to help us identify the issue and determine the appropriate solution.
Depending on the circumstances and your applicable statutory rights, remedies may include repair, replacement, price reduction or refund.
Nothing in these Terms & Conditions limits or excludes your statutory consumer rights.
14. Manufacturer Warranties
Many products sold by Samuel Johnston are supplied with a manufacturer's warranty.
Warranty periods and conditions vary by product and manufacturer. Please refer to the relevant product information or our Warranty page for details.
A manufacturer's warranty is in addition to, and does not replace or limit, your statutory consumer rights.
If you experience a problem with a product, please contact us in accordance with our Returns and Warranty procedures.
15. Product Safety
We take product safety seriously and require products offered for sale to comply with applicable legal requirements and relevant standards for the markets in which they are sold.
Individual products may comply with different standards depending on their category, intended use and market.
Where applicable, product pages may provide information about relevant standards, approvals or independent testing.
16. Voucher, Promotional & Discount Codes
Voucher and promotional codes are subject to the conditions stated with the relevant promotion.
Unless otherwise stated:
- codes are available for eligible purchases through samueljohnston.com;
- exclusions may apply to certain products, brands or categories;
- codes cannot be combined with another discount or promotion;
- codes must be entered correctly at checkout;
- discounts cannot normally be applied retrospectively after an order has been completed;
- delivery and other service charges are excluded from percentage discounts unless expressly stated otherwise;
- promotions are subject to product availability; and
- we reserve the right to withdraw or amend a promotion where reasonably necessary.
Supplier or brand restrictions may mean that particular products are excluded from promotions.
17. Sale & Clearance Items
Sale and clearance offers apply only to selected products.
Products included in a sale or clearance promotion will normally be identified on the website.
Unless otherwise stated, sale and clearance offers cannot be combined with other promotional offers or discount codes.
Sale and clearance products remain subject to your applicable statutory consumer rights.
18. Klarna & Other Payment Providers
Where available, we may offer payment services provided by third-party payment providers such as Klarna.
These services are subject to the relevant provider's own eligibility criteria and terms and conditions.
Where a third-party provider supplies credit or payment services, your agreement for those services may be directly with that provider.
Availability of a particular payment method is not guaranteed and may vary by order, customer or market.
Further information and Klarna’s user terms you can find here. General information on Klarna can be found here. Your personal data is handled in accordance with applicable data protection law and in accordance with the information in Klarnas privacy statement.
19. UK, Ireland & International Orders
Samuel Johnston operates fulfilment facilities in Belfast (UK) and Dublin (Ireland), allowing us to efficiently serve customers throughout the United Kingdom and Ireland.
For orders delivered within the United Kingdom, we will normally fulfil from our Belfast (UK) operation. For orders delivered to the Republic of Ireland, we will normally fulfil from our Dublin (Ireland) operation.
For standard orders delivered within the UK or Republic of Ireland, the price shown and paid at checkout includes the applicable VAT. Customers will not be asked to pay additional import VAT, customs duty or customs-clearance charges when their order is delivered.
Our UK and Ireland fulfilment network is specifically designed to avoid unnecessary cross-border customs processes. This means customers can shop with confidence knowing that there should be no unexpected import charges on delivery — the price agreed at checkout is the price you pay for your goods and the delivery service selected.
Orders may occasionally be fulfilled from a different warehouse, supplier or fulfilment partner where necessary. Where this happens, Samuel Johnston will arrange fulfilment so that customers in the UK and Republic of Ireland are not presented with unexpected import duties, import VAT or customs-clearance charges on delivery, unless we have clearly advised otherwise before the order is accepted.
We may also accept orders for delivery to other European Union countries and international destinations. Available destinations will be shown at checkout.
VAT, customs duties, import taxes and other charges can vary depending upon the destination and how an order is fulfilled. Where additional charges may be payable by the recipient, this will be made clear where reasonably possible before purchase.
Please refer to our Delivery information for further details.
20. Privacy & Cookies
We process personal information in accordance with our Privacy Policy.
Our website uses cookies and similar technologies for purposes including essential website functionality and, where applicable and subject to your choices, analytics, personalisation and marketing.
Further information about how we use personal information, cookies and similar technologies is provided in our Privacy Policy and cookie settings.
21. Website Security & Payments
We take reasonable technical and organisational measures to protect our website and customer information.
Payment transactions are processed using secure payment systems provided by our ecommerce platform and/or authorised payment providers.
We do not guarantee that our website will always be uninterrupted, error-free or completely free from malicious software, although we take reasonable measures to maintain its security.
22. Intellectual Property
Unless otherwise stated, the content of this website, including text, graphics, branding, layout and original images, is owned by or licensed to SJTK Limited trading as Samuel Johnston and is protected by applicable intellectual property laws.
Content may not be copied, reproduced, distributed or used commercially without permission, except where permitted by law.
Third-party trademarks, product images and other intellectual property remain the property of their respective owners.
23. Competitions & Giveaways
Where Samuel Johnston runs a competition or giveaway, additional terms may be provided with the relevant promotion. Those specific terms will apply alongside these general conditions.
Unless otherwise stated:
- competitions are open to eligible residents stated in the relevant promotion;
- employees of SJTK Limited and persons directly involved in administering the promotion are not eligible to enter;
- no purchase is necessary unless expressly stated;
- entry methods and closing dates will be specified in the promotion;
- entries received after the closing date will not be accepted;
- prizes are as described and are non-transferable, with no cash alternative unless otherwise stated;
- where necessary, we may substitute a prize with one of equal or greater value;
- winners will be selected using the method stated in the promotion and contacted using the details provided;
- if a winner does not respond within the period specified in the promotion, we may select another winner;
- personal information will be processed in accordance with our Privacy Policy; and
- where a promotion is conducted through a social media platform, it is not sponsored, endorsed or administered by that platform unless expressly stated otherwise.
We reserve the right to suspend, amend or cancel a promotion where circumstances outside our reasonable control make this necessary.
24. Our Liability
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
We are responsible for losses that are a foreseeable result of our breach of these Terms & Conditions or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Products sold through our consumer website are intended primarily for domestic and private use. We are not responsible for business losses such as loss of profit, loss of business, business interruption or loss of business opportunity arising from consumer purchases, except where the law provides otherwise.
25. Events Outside Our Reasonable Control
We will not be responsible for delays or failures caused by events outside our reasonable control.
These may include severe weather, transport disruption, industrial action, customs delays, supplier disruption, natural disasters, government action, failure of telecommunications networks or other circumstances which we could not reasonably prevent.
Where such an event materially affects an order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.
26. Changes to These Terms & Conditions
We may update these Terms & Conditions from time to time.
The Terms & Conditions that apply to an order will normally be those in force when the order is placed.
Changes made after an order has been placed will not retrospectively alter the agreed terms of that order unless required by law or expressly agreed with you.
27. Governing Law
These Terms & Conditions and contracts for purchases made through our website are governed by the applicable laws of the United Kingdom, subject to any mandatory consumer protections that apply to you based on where you live.
If you are a consumer, you retain any mandatory rights available to you under the laws applicable in your country of residence.
